Draft, pending legal review
Terms of use
These terms are a draft of the rules for using WalletMe. They are not legal advice, and they are not a final contract.
Who you are contracting with
These terms are with WalletMe. They do not name a state of incorporation. Questions go to hello at walletmeinc dot com.
WalletMehello at walletmeinc dot comThe service
WalletMe lets a business keep facilities, groups, a card template, customers, and email for those cards in one place. A customer can add an Apple Wallet pass from the link the business sends. Google Wallet is not available. NFC tap loyalty is not available.
Accounts
Signup asks for your name, email, password, company name, and the group you expect to use. You must check the box agreeing to these terms and the privacy policy before the request is sent. That box starts unchecked. An admin reviews the request before you can sign in. You are responsible for the activity under your password and under any API key the company creates.
Customer information
If you upload a customer’s name, email, balance, or password, you are responsible for having a lawful basis to do that, and for what you send them. WalletMe stores it so the company can issue the card and send the messages the company queues.
Price
There is no paid plan today, and WalletMe does not charge you. Refund terms will be published before any paid plan launches. The refunds page says the same thing. Nothing on this page is a “no refunds” rule.
Acceptable use
Do not use WalletMe to break the law, to send email the recipient did not need from the company, to probe someone else’s company, or to interfere with the service.
Apple Wallet
“Apple Wallet” is Apple’s name. The add control on a card link is text that points at the pass file. We do not redraw Apple’s logo. Adding a pass is handled by the device. Google’s wallet button is not shown, because that path is not available.
Disclaimers
The service is provided as it runs today. A pass may fail to add, an email may fail to send, and a draft policy may change after legal review.
Limitation of liability
To the extent California law allows, WalletMe is not liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Any liability is limited to the amount you paid WalletMe in the three months before the claim. Nothing is charged today, so that amount is zero. These terms do not limit a right that California law does not allow us to limit.
Indemnity
You will indemnify WalletMe against claims, losses, and reasonable legal costs that arise from the customer information you upload, the messages you send, or your misuse of the service, to the extent California law allows.
Law and venue
The laws of California govern these terms, without regard to conflict-of-law rules. That is a choice of governing law. It is not a statement of incorporation. The state and federal courts located in California are the venue for a dispute about these terms or the service.
Changes
